Smartphone Order Terms of Use

The Smartphone Order Terms of Use (hereinafter referred to as the "Terms") stipulate the matters to be observed when using the functions of the Mitsui Mitsui Fudosan Retail Management Co., Ltd. Park App (hereinafter referred to as the "App") and Smartphone Order (hereinafter referred to as the "Services") provided by Mitsui Fudosan Commercial Management Co., Ltd. (hereinafter referred to as the "Company"). Users of this Services shall use this Services after agreeing to the matters stipulated in these Terms. In addition, the terms of use and Services content of this Services may change without notice, so please always check the latest contents in the Terms of Use under "Information" in the app menu tab.

1. Contents of Services

The specific contents of Services that we provide to users shall be as set forth in the following items.

  • ・Providing information about exhibitors (hereinafter referred to as "Exhibitor Information") and information about food items (hereinafter referred to as "Products") sold by exhibitors (hereinafter referred to as "Product Information")
  • - Provision of a system that extracts and displays a list of products that match the specified product conditions by specifying the product conditions.
  • - To notify users and call them when the ordered products are available from the seller
  • ・Providing payment Services for ordered products
  • - View and manage order history
  • ・Provision of Mitsui Shopping Park point Services (only available if you have logged in via "Member Registration/Login" in the center of the home tab before ordering products)
  • ・Providing Parking fee discount (Parking fee discount vary by facility, so please check the facility's website for details.)
  • ・Issuing receipts for ordered items
  • ・Provision of Services related to Services listed above
2. Users of Services
This Services can only be used by downloading this application to your smartphone device, agreeing to the terms and conditions displayed on the Services screen, and being approved by our company for use of this Services after being authenticated by our company's designated method. Credit cards that do not meet the standards set by our company cannot be used. Furthermore, our company may, at its discretion, discontinue this Services without prior notice.
3. How to use Services

Users shall use this Services by following the steps below.
Please note that this Services may not be available at some facilities or stores.

  • - When using this Services for the first time, please confirm and accept the terms and conditions displayed, then tap the Agree button.
  • - From this Services, select the menu and quantity you want to order, tap the "Order" button, check the details, and then tap the "Add to cart with these details" button.
  • ・Please confirm the order details in your cart and proceed to "Payment".
  • - Enter your credit card information and tap the "Place order with this content" button to confirm your order.

[Items to confirm before use]

  • ・Please enter a valid credit card number and security code (the number written on the front or back of the card) to register.
  • - This Services cannot be used if approval for credit card payment using the registered card is not obtained from the issuer of the registered card.
  • ・When a credit card payment via this Services is completed, the User shall pay the amount paid by credit card via this Services to the issuer of the registered card or a person designated by the User in accordance with the credit card membership terms and conditions with the issuer of the registered card.
  • ・In principle, orders cannot be cancelled after they have been placed. However, cancellation will only be effective if the user requests cancellation from the store owner, the store owner accepts the request, and the store owner presses the cancel button on the order management terminal.
  • ・When the exhibitor has finished preparing the product, the user will be called on this app, so please go to the exhibitor's counter, show this app screen, and pick up the product. Even if the user does not come to pick up the product after being called, the transaction will be completed and the payment will be made by the registered credit card. Products that are not picked up will be discarded a certain amount of time after the call.
  • ・Users of this Services shall take responsibility for properly managing their smartphones, such as by setting a password on the smartphone, so that the Services cannot be used by a third party. Please note that we cannot be held responsible for any damages caused by the misuse of the smartphone by a third party.
  • ・If you are a Mitsui Shopping Park point member, you can accumulate and use Mitsui Shopping Park points (hereinafter referred to as "Points") by logging in via "Member Registration/Login" in the center of the home tab before ordering products.
  • - If the user does not log in via "Member Registration/Login" in the center of the home tab before ordering a product, points will not be awarded.
  • ・If you are a Mitsui Shopping Park point member, you can log in via "Membership Registration/Login" in the center of the home tab and the purchase amount will be automatically added to your point number, so there is no need to use the pre-payment machine.
  • ・If you are not a Mitsui Shopping Park Point member, or if you have not logged in via "Member Registration/Login" in the center of the Home tab before placing your order, you can use Parking fee discount by following the designated steps via the Parking Ticket button at the bottom of the Smartphone Order screen.
  • ・Regarding receipts, we will give you a "customer receipt and receipt" when you receive the product. To reissue the receipt, you can download it from "History/Parking Ticket" in this app.
  • ・With regard to the Mitsui Shopping Park Point Services, the provisions of the "Mitsui Shopping Park Point Membership Terms and Conditions" shall apply.
4. Handling of User Information
  • ・We use user information provided by users when using this Services, such as phone numbers, credit card information, ordered items, and Mitsui Shopping Park point numbers, for the following purposes. If we entrust the handling of personal information to a third party, we will properly supervise the third party to ensure the safe management of personal information.

[Purpose of use]

  • ・To notify exhibitors of ordered items
  • ・To call you when the ordered items are ready (We will call you via this app first, but the "Smartphone Order" support desk may call you at the phone number you registered.)
  • - To process payments using the credit card registered on the payment screen
  • ・To provide benefits based on usage trends at applicable facilities and stores, conduct surveys, and send out campaign information, etc.
5. Handling, disclosure, correction, etc. of personal information
For information on how we handle personal information, please see our "Privacy Policy" and "Concerning Protection of Personal Information" on our website. In addition, the person himself/herself or a representative with the authority to act on his/her behalf may request the disclosure, correction, addition, deletion, and suspension of use of personal information. 6. Suspension of Services

If a user falls under any of the following items or if the Company determines that a user falls under such items, the Company may suspend the user's use of all or part of Services.
Furthermore, even if a user suffers damage as a result of any measures taken by our company based on this article, we shall not be liable for any damages.

  • ・If the user violates any of these terms or the Mitsui Shopping Park App Terms of Use.
  • ・If the user makes a false statement during authentication or registration for this application.
  • ・If the user's identity verification procedure is not performed properly
  • ・If the user fraudulently uses credit information, coupons, etc., or allows a third party to use them.
  • - If the user makes a certain number of input errors in credit card information, coupons, etc., and we determine that it is necessary to suspend service from a security standpoint.
  • If the user fails to fulfill payment obligations to the issuer of the registered card
  • ・If the credit status of the user is significantly deteriorated due to seizure, bankruptcy, civil rehabilitation petition, suspension of transactions, etc.
  • - If the user is a member of an organized crime group, a gang member, a gang associate member, a company related to an organized crime group, a corporate racketeer, a social activist, a special intelligence violent group, or any other person equivalent thereto (hereinafter referred to as a "Member of an Organized Crime Group, etc."), or if the user falls under either of the following (1) or (2):
  • (1) Having a relationship that is deemed to be an inappropriate use of a gang member, etc., for the purpose of obtaining wrongful benefits for oneself, one's company or a third party, or for the purpose of causing damage to a third party
  • (2) Having a relationship that is deemed to be involved in providing funds or convenience to an organized crime group member or other such person.
  • - If the user violates the property rights (including intellectual property rights), personal rights (rights to reputation, portrait rights, rights to privacy) or other rights of our company, exhibitors or other third parties, or engages in any act that damages the reputation of such third parties.
  • ・When a user sends or posts harmful computer programs, emails, etc.
  • - If the user places an excessive load on or Access accesses the servers or other computers of our company used to provide the Services.
  • ・If we determine that the user's usage of Services is inappropriate.
  • ・If the user engages in any act that interferes with the operation or maintenance of this Services
7. Suspension, Termination and Changes to the Services

In any of the following cases, we may temporarily suspend all or part of the Services without prior notice to the user. In such cases, we shall not be liable for any damages incurred by the user.

  • - If Services cannot be provided due to a breakdown or failure of facilities, store operations, apps, servers, communication lines, or other equipment, or for other reasons.
  • ・When carrying out regular or emergency maintenance, inspection, repair or modification of systems (including servers, communication lines, power sources, and the buildings that house them, etc.)
  • - If Services cannot be provided due to fire, power outage, etc.
  • - If the provision of Services becomes impossible due to a natural disaster such as an earthquake, eruption, flood, or tsunami.
  • - When the provision of Services becomes impossible due to war, unrest, riots, civil unrest, labor disputes, or other force majeure.
  • - When it becomes impossible to provide Services due to laws and regulations or measures based on them.
  • - Any other cases where we determine it is necessary to temporarily suspend the Services for operational or technical reasons.
8.Agree
Please read and agree to these terms before using this Services. These terms are posted in the "Information" menu tab of this app, and are considered to be publicly available upon posting.
9. Changes to Terms
We reserve the right to revise these Terms at any time without prior consent from the user. We will notify you on our webpage and within the App, and will also post and publish the revised Terms in the "Information" menu tab of the App, so please check them. By using the Services, you will be deemed to have agreed to the revised Terms.
10. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of Japan. In the event of any dispute between the Services User and our company, the Tokyo District Court shall be the court of first instance with exclusive jurisdiction.
