Article 2 Membership and Registration

Article 4 Points
We will register points based on the amount of purchases made at participating facilities, stores, or online shopping sites.
1. Eligibility to register points
(1) Points will be registered according to the purchase amount (excluding consumption tax, etc.) only when a Member uses an applicable facility or store and presents a point card, affiliated card, or a point QR code provided by us on the Mitsui Shopping Park app, etc., at the time of payment, or when a Member uses online shopping site and purchases an item. Please note that points may not be registered on the day of payment, but at a later date. For details, please check the applicable facility, store, website, etc.
(2) Payment methods that are eligible for point registration are as follows. (This may vary depending on the store, product, or Services.)

[3] Payment by shopping vouchers, meal vouchers, or gift vouchers at participating facilities

Any payments that do not fall under the above payment methods will not be eligible for points registration.

2. How points are calculated

4. Points expiration date
The period from the first month of using the point card to the last day of the month before the month of using the point card in the following year is counted as one program year, and the points earned in that program year will be valid until the end of the following program year. Note that the points for the first program year will expire at the end of the month before the month of using the point card in the year after next, and the same process will be repeated from the next year onwards.
5. Checking point balance and expiration date
You can check your points balance and expiration date at the time of payment, on the receipt given to you after payment, or on the member's page.
6. Using points

Article 5 Point Card Issuance and Fees

2. If you do not register your membership information on the member's page, or if there are any incomplete or missing details in the registration information, you will not be able to use your points unless otherwise approved by our company.
3. Please input true and accurate information, and if there is any falsehood, error, or omission in the information, the member may suffer disadvantages such as not being able to receive Services, however, our company shall not be liable unless there is a reason attributable to our company.
4. There will be no fee for issuing the point card or any annual fee.
5. In principle, only one point card will be issued per person, and it can only be used by the person who signed on the back of the card. In addition, the point card cannot be lent or transferred to another person, and points cannot be transferred or transferred to another person.
Article 6 Loss or theft of point cards
1. Article 8 Changes to these Terms
1. In any of the following cases, our company reserves the right to change these terms and conditions without the consent of the member. When changing these terms and conditions, we will post the changes and the effective date of the changes on our website. We will also notify you on the websites of each facility and in our email newsletters.
(1) When the change to these Terms and Conditions is in the general interest of the Members
(2) When the change to these Terms and Conditions does not contradict the purpose of the contract and is reasonable in light of the necessity for the change, the appropriateness of the content after the change, the content of the change, and other circumstances related to the change.
2. If a Member uses Services after the effective date of the revised Terms and Conditions, the Member will be deemed to have agreed to the revised Terms and Conditions.
Article 9 Termination of Membership
If a member falls under any of the following items, he/she will lose his/her membership and all accumulated points will be forfeited.
1. If you have violated these terms and conditions and our company determines that you are unsuitable to be a member
2. If points have not been used for 48 months since the month of the last point registration (membership will expire at the end of the month. However, if points have not been used since registration, the month of registration will be counted as the starting month.)
3. If you hold multiple cards, you may lose your membership unless otherwise permitted by our company.
Article 10 Cancellation of Membership
Our company may cancel a member's membership without notice if the member falls under any of the following items. In addition, our company may cancel the member's membership and cancel all accumulated points at the same time.
1. If a member falls under the category of an organized crime group, a member of an organized crime group, a quasi-member of an organized crime group, a company related to an organized crime group, a corporate racketeer, etc., a social movement fraudster, a special intelligence violent group, etc., or any other person equivalent thereto (hereinafter referred to as "organized crime group member, etc."), or if the member falls under any of the following (1) or (2):
(1) Having a relationship that is deemed to be an inappropriate use of a gang member, etc., for the purpose of obtaining wrongful benefits for oneself, one's company or a third party, or for the purpose of causing damage to a third party
(2) Having a relationship that is deemed to be involved in providing funds or convenience to a gang member or other such person.
2. If a member commits any of the following acts (1) to (5) by himself/herself or through a third party:
(1) Violent demands
(2) Making unreasonable demands that go beyond legal responsibility
(3) Threatening or violent behavior in relation to transactions
(4) Spreading false rumours, damaging the credibility of our company through fraudulent means, or disrupting our business
(5) Any other acts equivalent to (1) to (4) above.
3. If a Member has been issued multiple cards by our company, when any of the events described in the previous two paragraphs occurs with respect to the other cards.
Article 11 Withdrawal
When a member cancels their membership, they must follow the procedures specified by our company. In addition, when canceling their membership, the member must return their point card. In addition, any points accumulated up until the time of cancellation (including when canceling an affiliated card) will be forfeited.
Article 12 Changes to and abolition of member benefits
Membership benefits and point Services contents may be changed or discontinued without notice.
Article 13 Emergency Measures
In the event of a natural disaster or other emergency, we may suspend all or part of the use of point cards and affiliated cards without prior notice to members.
Article 14 Contact point
Inquiries and consultations regarding these terms and conditions, member benefits and member information will be accepted at the applicable facility.
Article 15 Jurisdiction and Applicable Law
In the event of a dispute between a member and our company, the Tokyo District Court shall be the court of jurisdiction and the applicable law shall be Japanese law.

Article 1 Definitions
1. In these Terms, the following terms are defined as follows:
(1) "User" refers individually or collectively to anyone who searches, views or uses the content provided by this Services.
(2) "Registered User" refers individually or collectively to a User who has approved all of the terms and conditions of "Handling of Personal Information of Mitsui Shopping Park Point Members" and these Terms and Conditions, registered the necessary items of personal information and other information designated by the Company in advance (hereinafter referred to as "Required Items for Registration") in accordance with the method designated by the Company, applied for user registration, and whose registration has been approved by the Company.

(8) "Points" refers to Mitsui Shopping Park points awarded to users in accordance with the "Mitsui Shopping Park Point Membership Terms and Conditions."
(9) "ID" means a unique email address registered by a Registered User in accordance with the "Mitsui Shopping Park Point Membership Terms and Conditions."
(10) "Password" refers to an arbitrary character string that a Registered User sets at the time of user registration and uses in conjunction with the ID to log in to this Site. (Hereinafter, the ID and password are collectively referred to as "ID and Password.")
Article 2 Scope of these Terms
1. These terms and conditions apply to all users.
2. When using the Services, the User shall agree to and faithfully comply with the laws, regulations, these Terms and Conditions, the various rules separately established by the Company, Privacy Policy, etc.
Article 3 Changes to these Terms
1. In any of the following cases, the Company may change these Terms of Use without the prior consent of the user. In such cases, the Company will notify the user by displaying the details of the change and the effective date of the change on this website.
(1) When the change to these Terms and Conditions is in the general interest of the Members
(2) When the change to these Terms and Conditions does not contradict the purpose of the contract and is reasonable in light of the necessity for the change, the appropriateness of the content after the change, the content of the change, and other circumstances related to the change.
2. If a Member uses Services after the effective date of the revised Terms and Conditions, the Member will be deemed to have agreed to the revised Terms and Conditions.
Chapter 2 User Registration
Article 4 User Registration

2. Minors may not use the Services without the consent of their parent or guardian.
3. Notwithstanding the provisions of the preceding paragraph, if it is discovered that a minor user is using Services without the consent of a parent or guardian, the Company may take any or all of the measures set out in the following items without prior notice to the user.
(1) Suspension of the user’s use of the Services
(2) Suspend or request Shops to suspend the fulfillment of a transaction, such as the shipment of goods
4. Our company may reject a user registration application if the user falls under any of the items of Article 7, Paragraph 1 of these Terms of Use.
Article 5 Mitsui Shopping Park Point Members
1. With regard to the allocation and use of points, the provisions of the "Mitsui Shopping Park Point Membership Terms and Conditions" shall apply, with the exception of the following:
(1) In principle, for payment methods that are eligible for point registration, 1 point will be registered for every 100 yen of the purchase amount for each product ordered. Points will not be registered for amounts less than 100 yen. In addition, consumption tax, etc. are not eligible for point registration.
(2) Notwithstanding the preceding paragraph, the calculation method of some points may differ depending on our plans, Shops, products, etc.
(3) When you purchase a product using this Services, your registered points can be used as part or all of the product price and shipping fees, with 1 point being equivalent to 1 yen.
2. When guest User purchases a product using this Services, they can receive points by following the specified procedures within 90 days of purchase.
3. If the ID linked to a registered user is changed or expires, the user must promptly follow the procedures specified by the Company.
Article 6 Changes to User Registration Information
1. If there is a change in any part or whole of the name, address, email address, telephone number or other registered information (hereinafter referred to as "Registered Information"), the Registered User shall promptly change the Registered Information in a manner designated by the Company.
2. If a registered user fails to change the registered information, the user may suffer disadvantages, such as being unable to receive Services, but the Company shall not be liable for any damages incurred by the user or a third party, except in cases where such damages are attributable to the Company.
Article 7 Suspension of Use of Services and Cancellation of User Registration
1. If a user falls under any of the following items, our company may immediately suspend the user's use of the Services, cancel the user's registration, or take other measures without prior notice to the user.
(1) If it is discovered that the person has engaged in any of the acts set forth in Article 23 of these Terms of Use
(2) If it is discovered that there has been a delay in fulfilling payment obligations such as the price of goods or various fees, a delay in receiving goods, a refusal to return goods, or other default on obligations without a valid reason
(3) If it is discovered that your user registration has been cancelled in the past due to a violation of the terms and conditions of any Services provided by us or our group companies.
(4) If it is discovered that an applicant for user registration has not paid any fees (including, but not limited to, the purchase price of products, etc.; the same applies below) for other Services provided by the Company or its group companies (including, but not limited to, cases where the applicant has not paid any fees, etc. to a third party related to a payment method separately approved by the Company), or if it is discovered that the applicant has been unable to receive products, etc. for an extended period of time without a valid reason, has refused to return or exchange products, or has otherwise defaulted on obligations
(5) If the user is a member of an organized crime group, a gang member, a quasi-member of an organized crime group, a company related to an organized crime group, a corporate racketeer, etc., a social activist, a criminal organization with special intelligence, or any other person equivalent thereto (hereinafter referred to as a "Member of an Organized Crime Group, etc."), or if the user falls under any of the following items ① or ②:
1) Having a relationship that is deemed to be an inappropriate use of a gang member, etc., for the purpose of obtaining wrongful benefits for oneself, one's company or a third party, or for the purpose of causing damage to a third party
② Having a relationship that is deemed to be involved in providing funds, etc., or convenience to members of organized crime groups, etc.
(6) If the user, either by himself/herself or through a third party, commits any of the following acts ① to ⑤:
1) Violent demands
②Unreasonable demands that go beyond legal responsibility
③ Threatening or violent behavior in relation to use of the service
④ Any act of spreading false rumours, damaging the credibility of the Company through fraudulent means, or disrupting the Company's business
⑤ Other acts similar to ① to ④ above
(7) Any other case in which the Company reasonably determines that the content is inappropriate for the operation and management of the Services
Article 8 ID and Password Management
1. Registered users shall manage and store their IDs and passwords at their own responsibility.
2. Registered users may not transfer, lend, or disclose their IDs and passwords to third parties.
3. If a registered user discovers that his/her ID and password have been used illegally by a third party, he/she shall immediately contact the Company.
4. The Registered User shall be responsible for any disadvantage or damage caused by insufficient management of the Registered User's ID and password, negligence in use, or use by a third party, and the Company shall not be liable for such disadvantage or damage, except in cases where such disadvantage or damage is attributable to the Company.
Article 9 Handling of Personal Information
The handling of personal information in the "Mitsui Shopping Park &mall" Services will be in accordance with "Handling of Personal Information of Mitsui Shopping Park Point Members."
Article 10 Email Delivery
Registered users who have given their consent will receive notifications about this site via e-mail. Please note that these emails may contain advertisements and promotions. Even if you do not wish to receive such emails, we may provide you with information that we consider to be important.
Chapter 3 Purchase and Delivery of Products
Article 11 Purchase of Products
1. This Services is an online shopping site that provides Users with a venue for transactions with Shops, and all transactions that Users make with Shops using this Services are conducted directly between the Users and Shops.
2. Users can order products from Shops through this site by following the procedures set out by our company (hereinafter referred to as the "Application Procedures"). Please note that our company may change the specifications of the Application Procedures from time to time in order to improve the convenience of both users and Shops.
3. The payment methods and delivery methods that registered users can select when placing an order and other transaction conditions vary depending on Shops. Users should confirm these conditions at their own responsibility before proceeding with the application process for purchasing the product.
4. Once the Company has completed accepting the order and the User receives an email from the Company confirming the order details, a sales contract for the relevant Product, etc. will be concluded between the User and Shops. However, if the Product, etc. is not available as a result of ordering it from Shops store or warehouse (even if the Product, etc. is displayed as in stock, it may not be available due to subsequent stock fluctuations), Shops may cancel the order or shipment of the relevant Product, etc. and terminate the sales contract, and the sales contract for the relevant Product, etc. will be terminated when the User receives an email to the effect that the order or shipment is cancelled.
5. Notwithstanding the provisions of the preceding paragraph, if a user commits fraudulent or NA行in relation to the use of this Services (repeated cancellations without a valid reason, refusal to receive, inability to receive, etc.) or falls under any of the items of Article 7, paragraph 1, the Company or Shops may, at its discretion, cancel the sales contract or take other appropriate measures. In such cases, the Company and Shops may claim actual losses, such as shipping costs, from the user.
6. Delivery destinations for products using this Services are limited to within Japan.
Article 12 Payment Method
1. When a user purchases a product through this Services, the user shall pay to our company the price of the product, consumption tax, shipping fee, and various fees (cash on delivery fee, etc.) (hereinafter referred to as "Product Price, etc."). Other fees, etc. to be borne by the user will be clearly indicated on this website as appropriate. If the user does not make payment by the due date, the sales contract may be automatically terminated.
2. The User shall pay the product price, etc., by a credit card in the User's name or by any other method approved by the Company.
3. The payment methods available may differ depending on Shops. Also, each payment method has a maximum purchase amount, and orders exceeding that amount cannot be accepted.
4. In the case of payment by credit card, the user shall comply with the terms of a separate contract between the user and the credit card company. If a dispute arises between the user and a third party such as the credit card company, the parties concerned shall resolve the matter, and the Company shall not be held liable unless there is a reason attributable to the Company.
5. When paying by credit card, the User must be aware of the risk of credit card information being leaked and must enter such information at his/her own risk.
6. When paying by credit card, the number of installments available may vary depending on the credit card company you use.
7. If the User selects installment, revolving or bonus payments for credit card settlement at the time of ordering, documents relating to such transaction pursuant to Article 30-2-3-4 of the Installment Sales Act may be delivered by electronic means by the credit card company, and the User agrees to this in advance.
8. In the case of payment in advance at a convenience store or by PayEasy, if the payment procedure is not completed within three days after the User receives an email from us confirming the order details, the User will be required to cancel the order.
Article 13 Delivery Method
1. The ordered products will be delivered by the delivery company and packaging materials designated by our company or Shops.
2. Even if items are ordered at the same time, items from different Shops or shipping locations may be delivered separately.
3. Depending on Shops, it may take some time from the time of order to shipment.
4. Even if you specify a delivery date and time, we may not be able to deliver the item on the specified date and time due to unavoidable circumstances such as traffic conditions. Depending on the delivery address, we may not be able to accept your request for a specific delivery date and time. Also, there are Shops that cannot accept requests for specific delivery dates and times during periods such as the New Year holidays.
Article 14 Cancellation of order, refusal to receive, etc.
1. Cancellation of an order due to reasons attributable to the user will only be accepted within two hours of receipt of the order (hereinafter referred to as the "cancellation period"). If the cancellation period has passed, the user will not be able to cancel the order, unless there is a reason attributable to our company.
2. If canceling some of the products ordered at the same time would result in a change in the shipping fee borne by the user, the user will not be able to cancel the order.
3. If the Product cannot be delivered to the User due to the User's refusal or inability to receive the Product, the Product will be considered returned due to reasons attributable to the User, and the User will be required to pay the return fee set forth in Article 17, Paragraph 2.
Chapter 4 Return and Exchange of Products
Article 15 Return and Exchange Procedures

If a user wishes to return or exchange a product, they must contact us in advance by submitting a request on the "Return/Exchange Registration" page of this Services, and follow the procedures and return methods specified by our company. If a product is returned without a prior request on the "Return/Exchange Registration" page of this Services, the shipping costs will be borne by the user. 2. Products requested for return or exchange (hereinafter referred to as "products subject to return or exchange") must be packed and returned separately from the products ordered at the same time from the same Shops. When a return or exchange request is received on this site, we will issue a return acceptance number to the user.
3. Even if a user applies for a return or exchange, if the product to be returned or exchanged cannot be confirmed as having arrived at the location designated by our company within 8 days (or within the designated period set by each Shops) after the return acceptance number is issued, the user will be considered to have declined the return or exchange.
4. Regarding returns and exchanges, in addition to the provisions of this agreement, conditions set by Shops may apply.
Article 16 Returns and exchanges due to reasons of Shops
1. We will only accept requests for exchanges in the following cases, and will send you a replacement item. In such cases, we will cover the costs of returning the product to be returned or exchanged, and the shipping costs of the replacement item (excluding some Shops that do not allow exchanges).
(1) If the quality of the product does not conform to the terms of the contract
(2) In the case of a product damaged during delivery
(3) If the product you receive is different from what you ordered
2. In the case where we are unable to provide a replacement product as described in the preceding paragraph, we will refund the product price at the time of purchase by the user of the product to be returned or exchanged, and if the user used points or coupons to purchase the product to be returned or exchanged, we will return those points and coupons. However, if the coupon has expired, it cannot be returned. In addition, the user will return to us the points that were awarded when purchasing the product to be returned or exchanged.
Article 17 Returns due to User Reasons
1. Returns for reasons other than those listed in the preceding paragraph 1 will be accepted only if Shops selling the product separately approves them, or if the return is made within 8 days of receipt of the product (or within a designated period set by each Shops), and if none of the following conditions apply, provided that the return application is made in accordance with the procedure set forth in Article 15, paragraph 1.
(1) In the case of products that are marked on this website as "non-returnable or non-exchangeable"
(2) If the item has been used, altered, washed, or dry-cleaned
(3) If the delivery note is lost
(4) If the product tag or label is removed and lost
(5) If the condition of the product (including, but not limited to, the product and its accessories) is different from that at the time of delivery and is damaged, soiled, lost, or has an odor while in the user's possession.
(6) If the packaging of a product in which the packaging is part of the product is opened
(7) If the price of the product falls below the amount of the return fee set forth in Paragraph 2 of this Article
(8) If you order multiple items and return some of the items, the total purchase amount will be less than 4,990 yen (tax included).
2. In the case of the preceding paragraph, the cost of returning the product and refunding the product price, etc. (hereinafter collectively referred to as the "return fee"; if the user requests home pickup, this includes the home pickup fee) shall be borne by the user. (12) Using, creating, or distributing external tools that cause Services to take advantage of bugs not normally intended, or that have effects not normally intended
(13) Any act that places an excessive burden on the servers, computers, etc. of our company, our group companies, Shops, or other users
(14) Registering as a user using information that is false or inaccurate
(15) Intentionally sending false information
(16) The same user registers multiple times
(17) Offering to purchase a product without the intention of actually purchasing it
(18) Refusing to receive a product without a valid reason
(19) Excessively returning products without a valid reason
(20) Self-dealing, insider trading among related parties, and fictitious transactions
(21) Any other conduct that the Company deems inappropriate
Chapter 8 Others
Article 24 Suspension and Termination of Services
1. The Company may suspend or terminate the provision of the Services or Services incidental thereto to any specific User or all Users at any time without prior notice to the Services. The Company shall not be liable for any damage or disadvantage suffered by the User as a result of the suspension or termination of the Services.
Article 25 Separate Agreement
1. If any matter not stipulated in these Terms of Use arises in relation to the use of Services or any doubt arises regarding the interpretation of these Terms of Use, the Company and the User shall discuss the matter in good faith and resolve it.
Article 26 Governing Law, Jurisdiction
1. The establishment, effect, performance and interpretation of these Terms shall be governed by the laws of Japan, and in the event of any litigation arising from these Terms, the Tokyo District Court shall be the court of first instance with exclusive jurisdiction.
